and isn't the claim ineligible by the Rangers anyway because Malone would put them over the 10% maximum we are allowed to exceed the cap by in the offseason

I can answer the one part. For his cap space, from above, he waived Avery, so that freed up 4 million cap space. Malone didnt put him over the 10%. Nick can confirm when he got a claim on Malone. It must have been email or PM.

Yes, PJ is correct. Sean Avery was waived, however, in the process of doing all of the FAs today, I forgot to send him to the farm.
As for when NY claimed Malone, he emailed me on 11/20 @ 8:16pm.
